Third Party Vendor Terms - DVS

1. Definitions and Interpretation

“Agreement” means the Agreement for the Provision of Electronic Identity Verification Services between Verifi and the Organisation and capitalized terms have the same meaning in this Schedule.

“DVS” means the document verification service operated by the DVS Manager.

“DVS Manager” means the Commonwealth of Australia represented by the Department of Home Affairs and, also includes, in respect of each type of document supported by the DVS, the applicable entity whose official record data is matched against for that document and (in the case of Australian driver's licence information) Austroads Ltd ACN 136 812 390.

“Third Party Vendor” means DVS.

2. Application

2.1 The Organisation agrees to be bound by the terms and conditions in these Third Party Vendor Terms from the earlier of the Organisation first notifying Verifi that it intends to use or the Organisation subscribing for, accessing the Third Party Vendor Database or the Third Party Vendor Services.

2.2 Verifi may update these terms by posting the update version on the Verifi Website. The version of these terms available on the Verifi Website as at the time that the Database or Third Party Vendor Service is used shall govern such use.

3. Use of Third Party Vendor Database or Services

3.1 The Organisation agrees that:

3.1.1 The Organisation shall agree to and comply with either the current version of the “Business User Conditions” or the “ID Service Provider Conditions” (as applicable) published by the DVS Manager from time to time and available at https://www.idmatch.gov.au/; and

3.1.2 all disclaimers, exclusions, limitations of liability and indemnities that form part of this Agreement enure for our benefit of, and can be directly enforced by, the DVS Manager.

3.2 The Organisation acknowledges and agrees that where it fails to comply with clause 3.1, its access to the Third Party Vendor Database and Service may be terminated.
